These Terms of Service ("Terms") govern your access to and use of the Wise Woman mobile application and related services (the "App"), operated by Taganski Biotech LLC ("we," "us," or "our"). Please read them carefully. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance of These Terms
By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. These Terms form a binding agreement between you and Taganski Biotech LLC.
If you use the App on behalf of someone else, you represent that you are authorized to accept these Terms for them.
2. Educational Use Only — Not Medical Advice
Wise Woman is an educational fertility-awareness and cycle-tracking tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.
The App — including its charts, insights, lessons, and the AI educator — is intended to help you learn about and observe fertility-awareness methods. It does not diagnose any condition, does not prescribe or recommend treatment, and is not a substitute for professional medical care.
The App does not interpret your personal logged data to tell you that any given day is "safe" or "unsafe" for intercourse, and you should not treat anything in the App as such a determination. Always consult a qualified healthcare provider or a certified fertility-awareness instructor for advice about your individual circumstances, and seek emergency care for any urgent medical concern. Never disregard or delay professional medical advice because of something you read or saw in the App.
3. Fertility Awareness, Effectiveness, and No Guarantee
Fertility-awareness methods can be used to help avoid or achieve pregnancy, but their effectiveness depends heavily on correct and consistent use, your individual cycle, proper instruction, and other factors outside our control.
The App is a learning and tracking tool, not a contraceptive. We do not guarantee that using it will prevent pregnancy or sexually transmitted infections, or that it will result in conception.
You are solely responsible for any decisions you make about contraception, conception, or your health. The App provides no protection against sexually transmitted infections. If avoiding pregnancy is important to you, consider using a backup method and consulting a qualified instructor or healthcare provider. You use the App and any fertility-awareness method at your own risk.
4. The AI Educator
The App includes an AI educator that answers questions about fertility-awareness methods using a curated knowledge base. Its answers are generated automatically and are educational only — they are not medical advice and may be incomplete or, despite our efforts, occasionally inaccurate.
When you ask the AI educator a question, the text you type is processed by third-party AI providers to generate a response, as described in our Privacy Policy. Do not enter information you do not wish to share, and do not rely on the AI educator for medical, emergency, or personal-safety decisions. Use of the AI educator may be subject to fair-use limits.
5. Eligibility and Accounts
- Minimum age: You must be at least 16 years old to create an account or use the App. By using the App you represent that you meet this requirement.
- Accurate information: You agree to provide accurate account information and to keep it up to date.
- Account security: You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
- Termination: You may stop using the App and delete your account at any time (see the Privacy Policy). We may suspend or terminate access if you violate these Terms or use the App in a way that could harm other users or us.
6. Subscriptions and Billing
Wise Woman offers both free and paid (Pro) tiers.
- Where you buy determines who processes payment: Apple In-App Purchase (iPhone/iPad), Google Play (Android), or, on the web, PayPal (and, where available, Stripe). We do not store your card numbers, billing addresses, or financial details.
- Auto-renewal: paid subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period; your account is charged within 24 hours before renewal.
- Manage or cancel anytime in your platform's subscription settings — Settings > [your name] > Subscriptions (iOS), Google Play > Subscriptions (Android), or your web account settings. Refunds follow each platform's policy.
- Prices and features may change; continued use of a paid tier after a price change constitutes acceptance.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Reverse-engineer, decompile, or attempt to extract source code, except where permitted by law;
- Interfere with, disrupt, or place undue load on the App or its underlying services, including the AI educator;
- Attempt to gain unauthorized access to any account, system, or data;
- Resell, redistribute, or commercially exploit the App or its content without our written permission;
- Post, upload, share, or transmit any content that is unlawful, harassing, abusive, threatening, defamatory, obscene, hateful, or otherwise objectionable, or that bullies, intimidates, or harms another person;
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
Zero tolerance for objectionable content and abusive users. To the extent the App provides any community, messaging, or other features that let you share content or interact with others, there is no tolerance for objectionable content or for abusive, harassing, or threatening behavior. We may, at our sole discretion and without prior notice, remove or restrict any content and suspend or terminate the account of any user who violates these Terms or engages in such conduct. You can report objectionable content or an abusive user through the in-app “Report a problem” option or the contact details in the “Contact” section below, and we aim to review such reports promptly.
The App and its content (excluding your own data) are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the App for its intended purpose.
8. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any insight, prediction, or AI-generated answer will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
9. Limitation of Liability
To the fullest extent permitted by law, Taganski Biotech LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the App — including, without limitation, any unintended pregnancy, failure to conceive, or health outcome.
Where liability cannot be excluded by law, our total liability to you for all claims relating to the App is limited to the greater of the amount you paid us for the App in the twelve months before the claim, or USD 50. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply. You and we agree to resolve disputes in the courts located in Delaware, unless applicable law gives you the right to bring a claim in your local courts.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the "Last Updated" date above and, for significant changes, notify you through the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
